When you purchase CatWatchful software and install it on a target device, you are asked to complete billing information and payment method, which must contain your personal information such as identification (first name, last name, full address, email and credit card details), which is stored by the Payment Provider, not by CatWatchful.

We will also communicate with you in response to your enquiries, regarding any information or service you request, and to manage your "account". The RSA asymmetric public-private key cryptosystem (key size is 4096 bits) uses a public encryption key and a private decryption key. The public encryption key is stored in the database in the open. The private decryption key is stored in the database encrypted with AES 256 using a key consisting of the user's password and the secret key. It cannot be decrypted without the user's password and the secret key.
User credentials are the user login stored in the database. The user's password is not stored. We store only the password hash generated by the md5 hash function of users' passwords. We generate a public and private key pair for the RSA cryptosystem during user registration. This public-private key pair is unique for each user. The key pair is stored in the database encrypted with AES 256.
Login process: we use the user's password from the login form to decrypt the user's original private key.
Encryption data: We obtain open data from devices using the encrypted https protocol. We immediately begin the process of encrypting the data on the server in RAM without storing it on the server disks. We encrypt data using RSA using the user's public encryption key.
Encrypted data is saved to disk/server.
Decryption: We obtain the user's decrypted private key. We decrypt the user's text data using the user's original private decryption key. We display this information to the user.
We store all our users' data in encrypted form. We use an RSA asymmetric public-private key cryptosystem with a key size of 4096 bits (plus RSA) and an AES symmetric key algorithm with a key size of 256 bits (plus AES).
CatWatchful considers the use of its service to be private. However, we may disclose your personal information stored in your account and/or on CatWatchful's servers and databases, in order to:

This End User Licence Agreement shall be deemed the governing agreement between www.CatWatchful.com (hereinafter referred to as "we", "us", "CatWatchful" as the context requires) and the user of CatWatchful services (hereinafter referred to as "you", "user" as the context requires)
This Agreement shall be deemed to have come into effect immediately upon your use of any of the services provided by CatWatchful.
The terms and conditions contained in this Agreement are NON-NEGOTIABLE and are subject to acceptance "AS IS". If you do not agree with these Terms and Conditions, you must stop using CatWatchful immediately; however, your use of CatWatchful, whether single use, multiple use or continued use, shall be deemed your express agreement to the terms and conditions of this agreement.

The aforementioned services are provided "AS IS" and on an "Availability" basis, with no warranty or representation by CatWatchful that any of the services would be available at all times, and that such services, when available, would be accurate, error-free, uninterrupted or would produce the desired results.
CatWatchful may at any time suspend any of the aforementioned services or add any of the aforementioned services at any time, without prior notice or indication to the USER.
Any user who wishes to take advantage of and/or use CatWatchful services must register with CatWatchful on the website by submitting the online registration form available on the CatWatchful website.
CatWatchful reserves the right to accept or reject user registration at its sole discretion with or without assigning any reason.
The user acknowledges that they have no right to register on the website and that CatWatchful will have the final authority to accept or reject the user's registration.
The user shall enter only true, correct and accurate data for registration. If at any time it is determined that the information entered at the time of registration is false, misleading and incorrect, CatWatchful shall have the right to cancel the user's registration and suspend any service available to such user.
The user must provide all mandatory details required for user registration.
The user shall fill in the registration form themselves and shall not make use of any robotic system or any automated system to fill in the registration form.
The user shall not enter any detail in the registration form that they consider confidential and do not intend to disclose. CatWatchful does not guarantee or warrant that the information entered by the User will remain confidential and will not be seen by third parties.
The user shall not create any spam or false registration and/or shall not create multiple user accounts and/or shall not delete the website database.
The user shall create a username and password to log in to the website. The user undertakes not to share or disclose their username and password to any third party.
The username created by the user shall not be abusive, racist, offensive or contrary to legal provisions relating to the use of the name.
The user shall immediately inform CatWatchful of any unauthorised access to their user account or breach of any security of which they are aware.
All licences, permissions, consents, approvals, etc. that may be necessary to use CatWatchful services on the TARGET shall be obtained by the User at their own expense.
The User shall ensure compliance with all notices or instructions published on the CatWatchful website from time to time to enable use of the Service.
The User agrees at all times to comply with the requirements of the Information Technology Act 2000, as well as all rules, regulations, guidelines, statutes and notifications made thereunder.
The User shall be responsible for the setup or configuration of their system to access any Service.
CatWatchful is not SPY software and must not be used as such by the USER. The purpose of the services provided by CatWatchful is strictly to achieve the aforementioned objectives of (1) Parental control over minors; and (2) Employee Monitoring during Employment Hours and must be used only for such designated purpose and no other.
CatWatchful shall not be used to violate the privacy of or spy on any person. Any illegal use of CatWatchful Services shall be construed as a breach of this Agreement and upon knowledge of such breach; CatWatchful shall immediately cancel the services and block the USER's account, without prior notice to the USER.
To use CatWatchful, the user must register their Account with CatWatchful and install the CatWatchful Application on the TARGET's Device(s) that is intended to be monitored under this Agreement.
Before installing CatWatchful on the TARGET device, the USER acknowledges and understands that:
CatWatchful is the sole owner and holder of all CatWatchful services, including CatWatchful applications, programming codes, designs, logos, websites, web applications, databases, logic and any other tangible or intangible intellectual property right associated therewith. The user is granted only a permissive right simply as LICENSEE to use CatWatchful, subject to the terms, conditions and restrictions contained in this Agreement.
CatWatchful services may be available FREE or by subscription. In such case, the user is granted only a permissive right simply as LICENSEE to use CatWatchful, subject to the terms, conditions and restrictions contained in this Agreement.
It is clarified that the USER's USE of CatWatchful SERVICES is merely on a licence basis and is not a transfer of ownership of any of CatWatchful's services, property rights or intellectual property.
The user shall have no proprietary right, title or interest in any of CatWatchful's services or Properties.
The licence granted by CatWatchful to the user in this document means that CatWatchful grants the USER a limited, non-exclusive, non-transferable and revocable licence to:
The licence granted in this document only allows the USER to install CatWatchful on devices that are owned and legally possessed by the User, or devices on which the USER has received the express right from a third party to install CatWatchful.
This Licence does not permit the User to use CatWatchful on any device that is not their property or control, or for which the user does not have the legal right to use CatWatchful.
The licence granted in this document is revocable at any time at the sole discretion of CatWatchful, without prior notice or indication to the USER.

The USER acknowledges and agrees not to use CatWatchful in any way to spy, harass, abuse, stalk, threaten, defame or infringe or violate the rights of third parties.
The USER shall not use any MONITORED INFORMATION to harass, threaten, defame or offend the TARGET or any third party.
The user shall not share, filter, disclose, publish, separate or allow any third party to have access to the monitored information of the TARGET.
If you use the Software for parental control purposes, we will inform you how we may collect and use personal information of children under 13 and that we will not disclose it. If you use the Software for parental control, you must provide us with explicit consent to collect and use the personal information of your child(ren) by CatWatchful.
All services provided by CatWatchful are "AS IS" and "AVAILABLE" and CatWatchful does not warrant that the services provided by CatWatchful will be available at all times, or that such services, when available, will be accurate and error-free, precise, uninterrupted or according to USERS' expectations. The user agrees to use CatWatchful at their own discretion, risk and consequences.
CatWatchful does not warrant or guarantee that any of CatWatchful's services will be compatible with USERS' devices. Before using CatWatchful, the user must verify the compatibility of the TARGET DEVICE with CatWatchful.
CatWatchful uses Internet/DATA CONNECTIVITY to synchronise the MONITORED INFORMATION between the target device and the USER's account. Therefore, the performance of CatWatchful services depends on the availability of a strong Internet connection, in the absence of which the USER may not be able to view the MONITORED INFORMATION in a timely manner. CatWatchful assumes no responsibility if the USER is unable to monitor the target due to lack of Internet connection.
CatWatchful uses device memory and device disk space to store monitored information, which is not immune to corruption, data loss, deterioration or virus, spam or any other damage. CatWatchful shall not be liable if the MONITORED INFORMATION is corrupted, destroyed, altered or lost from the TARGET DEVICE and is not available to the USER for supervision.

The quality of the monitored information is subject to the accuracy and quality of the TARGET DEVICE. If the target device is not compatible or does not provide optimal clear output, such as camera, microphone, GPS, etc., then in such case the quality of the MONITORED INFORMATION may not be good and in many cases it may not even be possible to use or collect at all, for which CatWatchful assumes no responsibility.
CatWatchful may, at its sole discretion and without assigning any reason, suspend CatWatchful Services at any time without prior notice in order to carry out system maintenance and/or updates and/or testing and/or repairs or other related work. During this Suspension period, the USER may not be able to monitor the target, in which case CatWatchful is not responsible for any loss the USER may suffer due to the unavailability of CatWatchful services. CatWatchful complies with all industry standards relating to ELECTRONIC DATA security; however, the user and target understand and acknowledge that no security and protection measure is absolute and can be penetrated by various methods, and in such case loss of data and MONITORED INFORMATION may occur, for which CatWatchful shall not be liable to the user or target for the loss or leakage of any Information due to hacking, data theft or online security breach or for any other reason not under CatWatchful's control.
CatWatchful SPECIFICALLY RESTRICTS ANY UNAUTHORISED AND ILLEGAL USE OF CatWatchful SERVICES ON TARGETS AND THIRD PARTIES AND If the TARGET or any Third Party believes that their device has been incorrectly installed with CatWatchful, such Target or Third Party must immediately notify CatWatchful of such incorrect installation of CatWatchful on their devices.
Upon receiving such misuse information, CatWatchful will help the TARGET OR THIRD PARTIES to uninstall the CatWatchful application from their devices.
CatWatchful will also notify the USER to whom the device is linked regarding such misuse report and will seek clarification from the USER. If satisfactory clarification is not received from the USER, THEN CatWatchful will block the USER ACCOUNT and permanently suspend CatWatchful Services for such user and delete all MONITORED INFORMATION of such USER from its SERVER.
To the maximum extent permitted by law, CatWatchful shall not be liable to the USER or the TARGET or any THIRD PARTY in respect of any claim, suit or action, regardless of the nature of the cause of the claim, suit or action alleging any loss, injury or damage, direct or indirect, that may result from the use of CatWatchful; or for any loss of profits, income, data, information, contracts or savings, or any other direct, indirect, incidental, special or consequential damage arising from the use or inability of USERS to use CatWatchful; or any defect in CatWatchful SERVICES OR MONITORED INFORMATION; or the breach of this Agreement, whether in a contractual or tort action or based on a warranty.
The user undertakes to indemnify CatWatchful against all actions, claims, proceedings, costs and damages (including damages or compensation paid by CatWatchful on the advice of its legal advisers to compromise or settle any claim) and all legal or other expenses arising from any breach of the terms of use or any of the clauses of this Agreement or from any claim by Target or a third party based on any fact which, if proven, would constitute a breach of the terms of use of this website.
CatWatchful may provide subscription-based services to the USER.
The user who wishes to make use of such services shall pay the subscription fees as prescribed in the respective Subscription Package.
The user of such service shall be subject to the terms and conditions prescribed for each individual Service, in addition to the terms and conditions set out herein, to the extent that they are not inconsistent with such Subscription terms and conditions.
Notwithstanding any provision to the contrary in these terms of use or in the Subscription terms and conditions, any subscription fee paid shall be non-refundable, non-transferable, non-assignable, non-negotiable. Subscription fees once paid will not be refunded to the user under any circumstances, nor will subscription fees once paid be set off against any other Service.
The validity of the subscription and the services made available to the user under such subscriptions to the Services shall be in accordance with the terms and conditions set out in the respective Service terms and conditions.
Pending the validity of any subscription to the Service, if the user cancels their account, in such case the subscription fees/unused services shall be deemed appropriated and the user shall have no right to refund or adjustment of the subscription fees/unused services, nor shall such subscription fees/services be reactivated or reused by the user when creating a new account subsequently. The user hereby authorises CatWatchful to appropriate such unused subscription fees.
Pending the validity of any subscription to the Services, if CatWatchful terminates the user account due to any breach/violation of any of the terms of use, in such case it shall be deemed that CatWatchful has lost the subscription fees/unused services, and the user has no right to refund or adjustment of such subscription fees/services of any kind.
Pending the validity of any subscription to the Services, in the event that CatWatchful suspends the user account for a temporary period due to breach of any condition or terms of use, and pending such suspension period, in the event that the validity of any subscription to the Services expires, despite the suspension period, the validity of the Services subscription shall be deemed to have expired on its expiry date, and the user shall have no right to claim extension of the subscription period.
Any unused service or subscription fee upon expiry of the Services subscription period shall be deemed expired and the user shall have no right to carry over such unused services/fees.
The user hereby agrees that the subscription fees payable by the user to avail the services of a specific Service for a specific period, and it is up to the user to avail or not to avail such services. CatWatchful assumes no responsibility or obligation due to any failure on the part of the user to be unable to avail, either in part or in full, the services available under the specified subscribed Services.
The user shall be responsible for paying any applicable government tax, cessation, fees, bank transfer charges, etc. for subscribing to CatWatchful's paid services.
CatWatchful reserves the right to discontinue/terminate at any time the services available under any subscribed Service and the user shall have no right to avail or continue to avail such services available under such Services at all. CatWatchful will adjust any balance service/subscription fees available on the discontinued/terminated Services against any of the available Services, at the user's choice, subject to the terms and conditions of such Services.
The user shall not allow any third party to evaluate or use the USER ACCOUNT.
The User may not resell or assign rights or obligations to any third party of any kind.
The User shall comply with all applicable laws in relation to the specific law of the Information Technology Act 2000 and its 2008 amendments and all regulations framed thereunder.
The User shall not use the Service for any illegal purpose, including, but not limited to, criminal purposes.
The User shall not infringe any intellectual property right of any person and/or retain information on any computer system or otherwise with the intent to do so.
The User shall not violate or attempt to violate the security of the Website and/or any link to the website nor obtain unauthorised access to any information considered private by other Users or persons, including, but not limited to, access to data and information not intended for or logging into a server or account that the User is not authorised to access, attempting to probe, scan or test the vulnerability of a system or network or attempting to breach security or authentication.
CatWatchful may cancel the user account immediately and suspend the user's access to any service for no reason, in the event of:
CatWatchful reserves the unilateral right to add and/or change and/or remove and/or terminate or prematurely withdraw its Service or any part thereof at any time with or without prior notice to the User for any reason, including due to business exigencies and/or regulatory or statutory changes.
There shall be no liability on the part of CatWatchful to the User, TARGET or any third party in the event that CatWatchful exercises its unilateral right to modify or discontinue the Service.
CatWatchful may modify, add or remove any part of these Terms of use at any time, without prior notice, which shall come into effect immediately after its publication on the CatWatchful WEBSITE. It is the responsibility of users and targets to review these Terms of use before each use of the SERVICES and by continuing to use this Site, the user accepts such changes.
All notices and communications to CatWatchful shall be made in the English language and must be addressed to CatWatchful at its contract address as set out on the CatWatchful WEBSITE. The user must state their full and correct legal, postal and contact details to allow CatWatchful to process the communication. Any communication that does not comply with the above will not be considered and will be treated as SPAM.
The remedy available under this Agreement to CatWatchful in the event of the user's breach of any of the terms of use of this website, such as account cancellation, service suspension, loss of incentives, loss of subscription fees, etc. shall be without prejudice and in addition to any of the rights available to CatWatchful under the law.
The fact that CatWatchful does not insist on one or more occasions on strict compliance by the User with any of the terms of use shall not be construed as a waiver of any continuing or subsequent breach or delay in compliance with any of the terms hereof.
The validity, interpretation and execution of this Agreement shall be governed by the Laws of [India].
Any dispute arising in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of the Judiciary IN BHAVNAGAR, STATE OF GUJARAT, UNION OF INDIA to which the parties to this Agreement exclusively and unequivocally submit.
This Agreement shall constitute the complete and exclusive agreement between the User, Target and CatWatchful with respect to the use of CatWatchful's SERVICES, replacing any prior agreement, document or communication with respect thereto.
If you do not agree with the terms and conditions contained in this document, you must stop using CatWatchful immediately; however, your use or continued use of the CatWatchful SERVICE shall be deemed express proof and for all necessary legal implications of your consent, acceptance and binding to these Terms of use. Your use of CatWatchful's SERVICES shall be deemed consideration, the sufficiency of which you expressly acknowledge hereby, in exchange for your acceptance of these Terms of use, including any modifications made hereto from time to time.
All TARGETS AND THIRD PARTIES who have given their consent to be monitored by CatWatchful or those TARGETS OR THIRD PARTIES who have not given such consent, but after having knowledge of the use of CatWatchful on their devices have not reported such misuse within (24) hours of such knowledge to CatWatchful, shall be deemed to have given their consent for the use of CatWatchful and SHALL be subject to the TERMS OF THIS AGREEMENT.
READ THIS END USER LICENCE AGREEMENT ("EULA") CAREFULLY BEFORE PURCHASING OR USING THE CATWATCHFUL APPLICATION SOFTWARE (HEREINAFTER, SOFTWARE/LICENSED SOFTWARE). BY PURCHASING OR USING THE SOFTWARE, YOU AGREE TO ABIDE BY THE TERMS OF THIS EULA. IF YOU DO NOT ACCEPT THE TERMS OF THIS LICENCE, DO NOT INSTALL OR USE THE SOFTWARE AND DELETE THE SOFTWARE AND ALL RELATED FILES FROM YOUR DEVICE. THIS EULA IS A LEGAL AGREEMENT BETWEEN YOU (HEREINAFTER, THE USER) AND CATWATCHFUL (HEREINAFTER, THE APPLICATION PROVIDER/CATWATCHFUL) FOR THE USE OF THE SOFTWARE. BY DOWNLOADING, INSTALLING OR USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS EULA. IF YOU DO NOT ACCEPT THE TERMS OF THIS EULA, YOU MAY NOT DOWNLOAD, INSTALL OR USE THE SOFTWARE.
BY ACCEPTING THIS EULA, YOU AGREE TO INSTALL THIS SOFTWARE ONLY ON A DEVICE OR DEVICES THAT YOU OWN AND, FOR CLOUD-BASED OR OTHER MONITORING THAT DOES NOT REQUIRE INSTALLATION ON A DEVICE, TO USE IT ONLY IN CONNECTION WITH AN ACCOUNT, APPLICATION, OR PROGRAM TO WHICH YOU HAVE LEGAL RIGHT TO ACCESS. YOU ALSO AGREE TO INFORM ANY PERSON WHO USES A DEVICE WITH THE SOFTWARE INSTALLED AND ANY OTHER PERSON ENTITLED TO ACCESS A SUPERVISED ACCOUNT OF THE PRESENCE OF THE SOFTWARE. FAILURE TO DO SO MAY RESULT IN VIOLATION OF APPLICABLE LAW ON YOUR PART. YOU UNDERSTAND AND AGREE THAT YOU WILL BE RESPONSIBLE FOR ANY LEGAL COST INCURRED BY THE APPLICATION PROVIDER AND/OR BY ANY PERSON WHO USES A DEVICE WITH THE SOFTWARE INSTALLED AS A RESULT OF YOUR INCORRECT OR ILLEGAL USE OF THE SOFTWARE.

It is a violation of the laws of England and Wales to install surveillance software, such as the Licensed Software, on any device that you do not have the right to monitor. The law generally requires that you notify the owners of a device that it is being monitored. Violation of this requirement could result in severe monetary and criminal penalties imposed on the offender. You should consult your own legal adviser regarding the legality of using the Licensed Software in the manner you intend to use it before downloading, installing and using it. You assume all responsibility for determining that you have the right to control a device on which the Licensed Software is installed. CatWatchful will not be responsible if you choose to monitor a device without having the right to do so.
The licensed software and any other product offered on this website is licensed, not sold, to you. CatWatchful, as the application provider, reserves all rights not expressly granted to you.
The user acknowledges that the Software will be used for the purpose of monitoring, tracking and obtaining access to certain devices such as mobile phones and computers (including, among others, emails and text messages) of children and employees and other device owners with their consent, including through the use of devices on which the Software is installed.
The user agrees that the installation and use of the software will be in accordance with the laws of England and Wales governing the supervision of device, account, application or program activity and use, and that they will not use the software in violation of any law to which the user is subject, including any law, rule, ordinance or government regulation.
The user agrees to install this software ONLY on a device that is owned by a User or on a device for which the device owner has given the User permission and/or explicit consent for such installation. The User undertakes NOT to install this Software on any device that is not their property nor on any device for which the User has not received permission and/or explicit consent for such installation.
For cloud-based or other monitoring that does not require installation on a device, the User agrees to use this software ONLY in connection with an account, application or program to which the User has legal right to access.
The user acknowledges that it is prohibited and against the terms of this EULA not to inform any third party which device, account, application or program is being monitored by the user with the software.
The user consents not to allow any other person to access the information that the Software collects from the device, account, application or program on which the Software is installed.
The user understands that the CatWatchful Site and Software will be used solely for the purpose of (i) parental control of their children, (ii) by employers to monitor devices that belong to them and on which employees work, (iii) on a device that is owned by a user, (iv) by a user with the consent of the device owner.
The user acknowledges that physical access to a target device is required for the Software to be installed on that target device.
The User acknowledges that the Software cannot be installed remotely without the User's good faith possession of a target device with physical access to it. The software can be installed remotely on iOS devices, but iCloud credentials are required, which means the user can install the CatWatchful application only with the consent of the device owner or on the user's own device.
The user is aware that before installing the Software they must verify the compatibility requirements of their target device in accordance with the Compatibility Policy. In the event that they have not complied with the Compatibility Policy after installation, they accept that it is their responsibility and they will not be refunded.
The user understands that a target device must comply with the Compatibility Policy to use the Software with basic functions. Where more functions are required on a target device, a jailbreak (iOS) or rooting (Android) will be carried out, which is a legal procedure in accordance with the UK Copyright and Related Rights Regulations 2003.
The user is aware that CatWatchful is not responsible for the possible negative consequences arising from jailbreak (iOS) and/or root (Android) such as the cessation of warranty on a target device operating system; and/or possible failure of a target device; and/or any other possible damage or harm to a target device. Nevertheless, CatWatchful may provide the User with qualified technical assistance regarding jailbreak (iOS) and/or root (Android) of a target device, which may largely eliminate the aforementioned negative consequences, but only if a target device is subject to the Compatibility Policy. In any event, the User accepts this procedure at their own risk and agrees not to claim against CatWatchful for any damage that may be caused by this means.
The Application Provider grants you a revocable, limited, non-exclusive, non-transferable licence (hereinafter, the Licence) to (i) install the Software on one or more devices that you own or control, and (ii) view, review and use the Software and any related information provided to you by the Software, (iii) or use the Software for cloud-based monitoring of a specific account, application or program. Nothing in this EULA shall be construed as permitting the installation of the Licensed Software on any device that you do not own or control, or that you do not have the legal right to monitor, or to monitor any account, application or program that you do not have the legal right to monitor. For cloud-based monitoring, you may not distribute or make the Licensed Software available over a network where it could be used by multiple devices at the same time or on any device that you do not own or control or have the legal right to monitor. It is your responsibility to determine whether you have the legal right to monitor the device, account, application or program.
CatWatchful is designed for legal use. The Licensed Software is designed for use by those who have the legal right to monitor the device, account, application or program on which it is installed or used for monitoring. The Application Provider cannot provide you with legal advice regarding your use of the Licensed Software. Please note that in most cases it is considered a violation of the laws of England and Wales to install or use surveillance software, such as the Licensed Software, on a mobile phone or other device, account, application or program that you do not have the right to supervise. The law generally requires you to notify the users or owners of the device, account, application or program that the device, account, application or program is being monitored. Failure to do so may result in violation of applicable law, which could result in severe monetary and criminal penalties imposed on the offender. You should consult your own legal adviser regarding the legality of using the Licensed Software in the manner you intend to use it before downloading, installing or using the Licensed Software. You assume all responsibility for determining that you have the right to control the device, account, application or program on which the Licensed Software is installed. The Application Provider shall not be liable if the User chooses to monitor a device, account, application or program that the User has no right to monitor.
You agree not to use the Licensed Software in any way to harass, abuse, stalk, threaten, defame or infringe or violate the rights of any other person, and that the Application Provider is in no way responsible for such use by you, nor for any harassing, threatening, defamatory, offensive or illegal message or transmission you may receive as a result of using the Licensed Software. In the event that the Licensed Software is installed on the device without the owner's permission, the Application Provider has the right to open uninstallation instructions for this person and ensure that an offender's account is blocked. Please note that all data on CatWatchful's servers is encrypted to protect the privacy of the account holder.
It is understood and agreed that the Application Provider is the owner of all rights, titles and interests in the original and any copy of the Licensed Software and related information, improvements, enhancements or derivatives thereof and the property of all intellectual property rights pertaining thereto, in whole or in part, shall be the exclusive property of the Application Provider, shall vest in and remain the exclusive property of the same. You, as licensee, by downloading, installing or using the Software do not acquire any proprietary rights in the Licensed Software. The Licensed Software is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. The rights granted under this licence are limited to the right to download, install.
You agree that you cannot and will not: (i) sell, lease, rent, licence, sublicense, redistribute, assign or grant the Licensed Software; (ii) decompile, disassemble or reverse engineer the Licensed Software, in whole or in part; (iii) write or develop any derivative software, attempt to derive the source code, modify or create derivative works of the Licensed Software, any update, or any part or any other software program based on the Licensed Software; (iv) provide, disclose, divulge or make available or permit the use of the Software by third parties without the prior written consent of the Application Provider; or (v) copy the Software.
Any attempt to do so shall be deemed a violation of the EULA and the rights of the Application Provider. If you breach this restriction, you may be subject to legal action and damages.
The Application Provider may provide improvements, modifications, updates or additions (hereinafter, the Modifications) to the Licensed Software during the term of the Licence. The terms of this EULA shall apply to any Modification unless such Modification is accompanied by a separate licence, in which case the terms of that licence shall apply.
You represent that participation under this EULA will not violate any agreement to keep confidential proprietary information acquired by you in confidence or in trust prior to this EULA. You represent that you have not entered into and will not enter into any oral or written agreement that conflicts with the foregoing.
You agree that the Application Provider may collect and use technical data and related information, including, among other things, technical information about your device, system and application software and peripherals, which is collected periodically to facilitate the provision of software updates, product support and other services to you (if any) related to the Licensed Software. You agree that the Application Provider may use this information, as long as it is in a form that does not personally identify you, to improve its products or to provide you with services or technologies. The Application Provider will use data that personally identifies you only in the normal course of business with you directly and will not disclose such data to other parties except as required by courts or law enforcement agencies or as set out in the Privacy Policy.
You agree that at no time before or after this EULA will you use or disclose improperly any proprietary information or trade secrets of any other person that may be in your possession, as applicable. In addition, in the event that the Application Provider discloses confidential information of its third party licensors, you will comply with the use and confidentiality guidelines that the Application Provider requests of you. You will maintain all confidential and proprietary information in the strictest confidence and will not disclose it to any third party or use it for the benefit of any person other than the Application Provider or such third party.
The Licensed Software enables access to third party services and websites (hereinafter, the Services). You understand that when using the Services, you may encounter content that may be considered offensive, indecent or objectionable, which content may or may not be identified as having explicit language, and that the results of any search or entry of a particular URL by you or any person having control of the monitored device, account, application or program may automatically and unintentionally generate links or references to objectionable material. However, you agree to use the Services at your own risk and that the Application Provider shall not be liable for content that may be offensive, indecent or objectionable.
Certain Services may display, include or make available content, data, information, applications or materials from third parties (hereinafter, Third Party Materials) or provide links to certain third party websites. By using the Services, you acknowledge and agree that the Application Provider is not responsible for examining or evaluating the content, accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality or any other aspect of such Materials or third party websites. The Application Provider does not warrant or endorse and does not assume and will not have any liability to you or any other person for third party Services, Materials or websites, or for any other third party material, product or service.
The services may contain content, information and material that is protected by applicable intellectual property and other laws, including, among others, copyright; you will not use such content, information or proprietary material except for the permitted use of the Services.
The term of this Licence runs concurrently with the term of your subscription plan, which is the period during which you are authorised to use the Licensed Software. Your rights under this Licence will terminate automatically without notice from the Application Provider if you fail to comply with any of the terms of this EULA or if your subscription period expires. Upon termination of the Licence, you must cease using the Licensed Software and uninstall it from all devices on which it was installed.
This non-transferable limited warranty covers the Software during the period of your subscription plan after purchase of the Licence. If you receive supplements, updates or replacement Software during that time, the limited warranty will extend to the end of your subscription plan. To the extent permitted by law, this implied warranty lasts only for the term of the limited warranty.
This limited warranty does not cover problems caused by your actions (or failure to act), the actions of others or events beyond the reasonable control of the Application Provider.
In the event of technical problems with the Software, you may request professional help from the CatWatchful Customer Care Centre, which will provide you with full support under the limited warranty during your subscription plan.
If you have technical problems with the Software that the CatWatchful Customer Care Centre cannot resolve, the only remedy for which you are eligible is a full refund in accordance with the Refund Policy.

TO THE EXTENT PERMITTED BY APPLICABLE LAW, CATWATCHFUL SHALL NOT BE LIABLE TO YOU IN RESPECT OF ANY CLAIM, SUIT OR ACTION, REGARDLESS OF THE NATURE OF THE CAUSE OF THE CLAIM, SUIT OR ACTION ALLEGING ANY LOSS, INJURY OR DAMAGE, DIRECT OR INDIRECT, THAT MAY RESULT FROM THE USE OR POSSESSION OF THE SOFTWARE; OR FOR ANY LOSS OF PROFITS, INCOME, DATA, CONTRACTS OR SAVINGS, OR ANY OTHER DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGE ARISING FROM THE USE OR INABILITY TO USE THE SOFTWARE, ANY DEFECT IN THE DATA OR THE BREACH OF THIS EULA, WHETHER IN AN ACTION FOR CONTRACT OR TORT OR BASED ON A WARRANTY, EVEN IF CATWATCHFUL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
This contract does not intend and does not (a) change or exclude any consumer legal right that cannot be legally changed or excluded, or (b) limit or exclude any right you may have against any other party if you did not purchase the Software directly from the CatWatchful website. Some jurisdictions do not allow certain liability exclusions, damage limitations or warranty disclaimers. In no event shall CatWatchful be liable for your use of the Software.
This End User Licence Agreement constitutes the complete, final and integrated agreement between the Parties in relation to the subject matter hereof and replaces all prior and contemporaneous understandings and communications, whether oral or written, between the Parties in relation to the subject matter hereof. The Application Provider reserves any right or licence not specifically granted herein. You may not assign this EULA (by law or otherwise) or transfer it in any way without the prior written consent of the Application Provider.
You acknowledge that breach of this EULA would cause irreparable harm to the Application Provider for which monetary damages are not an adequate remedy. Accordingly, the Application Provider shall be entitled to seek injunctive relief and other equitable remedies in the event of breach.
YOU EXPRESSLY ACKNOWLEDGE THAT YOU HAVE READ THIS EULA AND UNDERSTAND THE RIGHTS, OBLIGATIONS, TERMS AND CONDITIONS SET FORTH HEREIN. BY CONTINUING WITH THE INSTALLATION OF THE SOFTWARE, YOU EXPRESSLY AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS.
Nothing in this EULA grants or purports to grant to any third party any benefit or right to enforce any term of this Agreement, and the provisions of the Contracts (Rights of Third Parties) Act 1999 (as amended from time to time) are expressly excluded.
This EULA shall be construed in accordance with the laws of England and Wales, and you accept the exclusive jurisdiction of the English courts.
Although the Software may be accessed worldwide, we do not guarantee that the Software or related materials are appropriate or available for use in your location, and the Software may not be accessed from territories where the content is prohibited by local laws. Those who choose to access the Software from such locations do so on their own initiative and are responsible for compliance with local laws, to the extent that local laws are applicable. Any offer and/or information made in relation to the Software is void where prohibited.
Without prejudice to the foregoing, the Software may not be exported or re-exported (a) to (or to a national or resident of) any country under US embargo or (b) to anyone on the US Treasury Department's list of designated individuals or the US Department of Commerce's list of denied persons or entities. By accessing and using the Software, you represent and warrant that you are not located in, under the control of or a national or resident of any such country or on any such list.
